Terms of Service

1. Parties

These Terms of Service ("Terms") govern your access to and use of FarmTrack, operated by Luc van Rhyn ([VERIFY: legal entity name and registration number]), a software service based in the Republic of South Africa.

By creating an account or using the service, you agree to these Terms. If you do not agree, do not use FarmTrack.

2. The service

FarmTrack provides a cloud-based livestock farm management platform including: animal records, camp and rotation management, observation logging, farm mapping, breeding analysis, financial reporting, and AI-assisted features (collectively, "the Service").

We reserve the right to modify, suspend, or discontinue features with reasonable notice to active subscribers.

3. Subscription tiers

FarmTrack offers three subscription tiers:

  • Basic — Self-serve onboarding, core livestock records, camp management, and standard reporting. LSU-based pricing.
  • Advanced — All Basic features plus AI onboarding wizard, breeding module, veld-condition scoring, SARS tax exports, and priority support. LSU-based pricing.
  • Consulting — All Advanced features plus a dedicated onboarding specialist and monthly strategy sessions. 12-month minimum term. Custom pricing.

4. Billing and payment

Payments are processed by PayFast (Pty) Ltd, a PCI-DSS compliant South African payment gateway. We do not store your card details.

Subscriptions are billed monthly or annually in advance. Monthly billing carries a 20% premium over the annual rate to cover flexible-billing costs.

Failed payments result in a grace period of [VERIFY: grace period — e.g. 7 days] before service suspension. You will receive email notice of failed payments.

5. Cancellation and refunds

Basic and Advanced subscriptions are month-to-month with no minimum term. You may cancel at any time; service continues until the end of the paid billing period. No refunds are provided for partial months.

On cancellation, your data is retained for [VERIFY: data retention period post-cancellation] before deletion. You may export your data at any time during the subscription.

6. Acceptable use

You agree not to:

  • Use the Service to store or transmit unlawful content.
  • Attempt to gain unauthorised access to other tenants' data or the underlying infrastructure.
  • Reverse engineer, decompile, or extract the Service's source code.
  • Use the Service in a manner that exceeds reasonable usage limits or interferes with other users' experience.
  • Resell or sublicense the Service without prior written consent.

7. Your data

You retain ownership of all farm data you enter into FarmTrack. We do not claim any intellectual property rights over your data. We process your data only as described in our Privacy Policy.

You are responsible for ensuring the accuracy of data you import and for complying with any obligations to third parties (e.g. stud breeders, co-owners) whose livestock data you enter.

8. Intellectual property

All software, designs, algorithms, and content comprising the FarmTrack Service remain the intellectual property of [VERIFY: IP-owning entity]. Nothing in these Terms transfers IP ownership to you. You receive a limited, non-exclusive, non-transferable licence to use the Service during your subscription.

9. Limitation of liability

To the maximum extent permitted by South African law, FarmTrack is provided "as is". We are not liable for indirect, incidental, or consequential losses arising from your use of the Service, including but not limited to livestock losses, financial decisions made based on platform data, or data loss caused by events outside our reasonable control.

Our aggregate liability to you in any 12-month period is limited to the fees you paid during that period.

10. Governing law and disputes

These Terms are governed by the laws of the Republic of South Africa. Any dispute that cannot be resolved informally will be referred to the courts of South Africa, with jurisdiction in [VERIFY: jurisdiction — e.g. Western Cape High Court, Cape Town].

11. Changes to these Terms

We may update these Terms from time to time. Material changes will be notified to active subscribers by email at least 30 days before they take effect. Continued use of the Service after that date constitutes acceptance of the updated Terms.
